Supreme Court’s Equal Employment Ruling

In the arena of the Supreme Court with regard to the Equal Employment Opportunity Commission (EEOC), a key ruling was recently made. Described as a “narrow and technical victory” acknowledging the limited power of courts to review the EEOC’s  required conciliation efforts prior to filing suit, according to The Wall Street Journal’s Civil Litigation blog post Legal Experts Weigh in on Supreme Court’s EEOC Ruling.

The responses from legal experts across the country are varied  yet many see it as a big victory for complainants working through the EEOC.

According to the post, “the EEOC annually fields tens of thousands of claims of workplace discrimination, harassment and retaliation, typically involving race, gender and age. In fiscal 2013, the commission filed 148 lawsuits and reported it had about 1,400 successful conciliations, compared with about 2,000 unsuccessful ones.”

“I think it’s unambiguously a win for the EEOC and complainants,” University of Colorado law professor Melissa Hart, who specializes in civil procedure and employment discrimination, told Law Blog on Wednesday.
