Recent Changes to Court Rules

 

Last week, our SmartRules Blog featured the 2014 changes to the California State Courts. This week, we will provide an overview of other states across the country that have amended existing local rules, added rules, or repealed rules:

 

 

 

 

Electronic Filing

 

San Francisco, California Superior Court expands mandatory e-filing beginning January 27th.

Electronic Filing has become mandatory in the Texas counties of Bexar, Collin, Dallas, Denton, El Paso, Fort Bend, Harris, Hidalgo, Tarrant and Travis on January 1st.

Franklin County Ohio Court of Common Pleas Electronic Filing Order has been amended effective December 20, 2013.

South Dakota Supreme Court new Electronic Filing Rules are effective January 1st.

 

New and Amended Local Rules

 

Northern District of New York Local Rules amended effective January 1st.

Amendments to the California Rules of Court are effective January 1, March 1 and July 1, 2014.

Massachusetts Rules of Civil Procedure were amended effective January 1st.

Massachusetts Trial Court Local Rule 34 “Producing Documents, Electronically Stored Information…” is amended effective January 1st.

Maryland Court Local Rules were amended January 1st.

Colorado Rules of Civil Procedure were amended December 31, 2013.

Illinois Supreme Court Rules 15 & 138 and 501, 526, 527 & 551 were amended effective January 1st.

Missouri Court Rules will be amended effective July 1, 2014.

 

Fee Changes

 

New Hidalgo, Texas filing fees became effective January 1st.

El Paso County, Texas Court Fees increase effective January 1st.

Dallas County, Texas District Court filing fees will increase by effective January 1st.

 

OTHER RECENT UPDATES

 

Federal Rules of Civil Procedure

Federal Rules of Civil Procedure were amended effective December 1, 2013.

 

Arizona

Supreme Court amendments to Rules of Civil Procedure, Rules of Evidence, Rules of the Supreme Court, etc. are effective January 1, 2014.

The Rules of Civil Procedure were amended effective January 1, 2013.

 

Massachusetts

Superior Court Rules are amended effective January 1,2014.

 

Michigan

Supreme Court amends rule 2.512 – Instructions to Jury – effective March 1, 2014.

Comments are due by January 1, 2014.

 

Missouri

The Supreme Court Operating Rules 7 and 15 are amended January 1, 2014.

Supreme Court Rule 4.53, Uniform Record Keeping System, is amended effective January 1, 2014.

Supreme Court Rule 5.09, Investigations – Conduct – Subpoenas, is repealed and rewritten effective January 1, 2014.

Eastern District Court amends Local Rule 6.03, Certification of Neutrals effective January 1, 2014.

 

Texas

Rules of Civil Procedure are amended effective January 1, 2014.
