Changes in New York State Court’s Commercial Division

As of April 1, 2015, the state courts of New York have ushered in a series of changes including new commercial division rules, amendments, and proposed amendments.  The preamble to commercial rules, effective as of April 1, 2015 reads, ““The Commercial Division understands that the businesses, individuals and attorneys who use this Court have expressed their frustration with adversaries who engage in dilatory tactics, fail to appear for hearings or depositions, unduly delay in producing relevant documents, or otherwise cause the other parties in a case to incur unnecessary costs.”

The Commercial Division dates back to 1993 when the Civil Division of the Supreme Court of New York County created a commercial division, initially as an experiment to examine whether creating a concentrated commercial litigation segment would improve the efficiency of the courts to handle said matters.  The formation of a commercial division proved to be highly successful and today it serves as a forum for resolving complicated commercial disputes. https://www.nycourts.gov/courts/comdiv/history.shtml
