January 2014 Rule Changes In The California Courts

 

The California Courts have experienced numerous rule changes, amendments, repealed rules and new rules effective January 1, 2014.

Here is an overview of just some of the changes featured in SmartRules, which publishes civil litigation guides in 12 California Counties including Los Angeles, San Francisco, San Bernardino, Orange, San Mateo, Ventura, Riverside, Sacramento, San Diego, Alameda, Santa Clara and Contra Costa:

 

CALIFORNIA RULES OF COURT

Three of the California Rules of Court (known as “CRCs”) included in the SmartRules guides were amended effective 1/1/2014.

One such rule is CRC 3.670 which was amended to expand the scope and application for telephonic appearances. Another California Rule of Court, CRC 3.1207, was amended regarding Ex Parte appearances.

 

LOS ANGELES COUNTY

The Los Angeles County Superior Court (LASC) local rules that are included in the SmartRules guides included three rule amendments. One key Los Angeles Superior Court local rule amendment concerns LASC LR 3.6 (Los Angeles Superior Court Local Rules 3.6); this amendment included the addition of ex parte applications for telephonic appearances.

 

SAN FRANCISCO COUNTY

The San Francisco County Superior Court amended 6 civil litigation rules covered by SmartRules. The changes involved amendments pertaining to the topics of e-filing (Electronic Filing), motions, and hearing dates.

 

RIVERSIDE COUNTY SUPERIOR COURT

The Riverside County Superior Court amended 2 civil litigation local rules in addition to repealing 2 local rules covered in the SmartRules guides as of 1/1/2014. These amendments pertain to case management conferences, jury instructions, case assignment and service of pleadings. In particular, Riverside Superior Court Local Rule 3140, which pertains to the service of pleadings, was repealed.

 

Other amendments to civil litigation local rules in California include Orange County, which featured a rule change involving Electronic Filing, and San Mateo County, which added a new rule pertaining to e-filing.
